New Place of Supply Rules

Hi,

As a business owner, am I permitted to reclaim the GST portion of HST paid on a purchase (for re-sale) in Ontario?

My business is in a province that doesn't have HST and I am registered for GST.

Hi Rosie,

You get to claim the whole amount of HST paid ... even if you live in a GST province ... just make sure you keep your invoice/receipt for proof.

However, under new place of supply rules, unless you were physically in Ontario, you should not have been charged HST. The business is supposed to charge the sales tax based on the location of the customer in most instances.
